In the Ohio case, the U.S. 6th Circuit Court of Appeals ruled the state tax credits that convinced DaimlerChrysler to expand its assembly plant in Toledo were unconstitutional because they interfered with interstate commerce.

That ruling has state and local economic development officials worried. Lawyers for the Michigan Economic Development Corporation, the city of Grand Rapids and The Right Place economic development program have jumped into the battle, filing arguments in support of Ohio's tax credits.

That's because Michigan has offered similar credits worth more than $4 billion to 220 projects in the past nine years. The 65 projects in which the credits were collected have created more than 13,000 jobs, MEDC officials say.

"Essentially, the program is for any situation in which Michigan is in direct competition with another state or country for a major corporate project," MEDC spokesman Paul Krepps said.
